Terms of Use

Draft — not final. This is placeholder text and has not been reviewed by a lawyer. It will be replaced with counsel-reviewed Terms before being relied on for real disputes.

These Terms of Use govern a vendor's use of the OrdersDuck platform, operated by Flying Duck Marketing ("OrdersDuck", "we", "us"). By creating a store on OrdersDuck, you agree to these terms.

1. What OrdersDuck is

OrdersDuck is a platform that lets local businesses ("vendors") set up their own online storefront to take orders directly from customers. OrdersDuck facilitates the technology — listing, storefront, order management, and optional payment/communication tools — but is not a party to the sale between a vendor and its customers.

2. Vendor responsibilities

3. Verification and listing

A new store is reviewed before it can accept real orders. OrdersDuck may approve, delay, or decline to publish a store at its discretion, and may suspend or remove a listing at any time if it appears fraudulent, non-compliant, duplicate, or otherwise unsuitable for the platform.

4. No liability for vendor-buyer disputes

OrdersDuck is not responsible for the quality, safety, legality, or delivery of any product sold through a vendor's storefront, and assumes no liability for disputes arising between a vendor and a customer.

5. Jurisdiction and disputes

Any dispute of any kind arising out of or in connection with this agreement, or your use of OrdersDuck, is subject to the exclusive jurisdiction of the courts at Mumbai, Maharashtra, India. This agreement is governed by the laws of India.

6. Changes

We may update these Terms from time to time. Continued use of the platform after a change constitutes acceptance of the updated Terms.
